Terms of Service

These Terms of Service ("Terms") govern your access to and use of DevoRadar (the "Service"), operated by DevoRadar ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
DevoRadar provides lead-intelligence tools built from publicly available New South Wales planning and development records. We organise, classify and present this information and provide optional outreach tools (such as print-and-post letters). The Service helps you identify potential work; it does not guarantee leads, contracts, or business outcomes.
2. Eligibility & accounts
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account details, for keeping your password secure, and for all activity under your account. Notify us promptly of any unauthorised use.
3. Subscriptions, credits & billing
- Paid plans are billed in advance on a recurring monthly basis through our payment processor (Stripe).
- Monthly allowances (such as lead opens and posted letters) reset each billing period and do not roll over; separately purchased credits roll over until used.
- Subscriptions renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period.
- Except where required by law (including the Australian Consumer Law), fees already paid are non-refundable.
- We may change pricing on reasonable notice; changes apply from your next billing period.
4. Acceptable use
You agree not to:
- resell, redistribute or sub-licence the data or bulk-export it other than through features we provide;
- scrape, copy or systematically extract the Service except as expressly permitted;
- use the Service to send unlawful, misleading or unsolicited electronic marketing in breach of the Spam Act 2003 (Cth) or to harass any person;
- attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.
You are solely responsible for your own marketing and outreach and for complying with all applicable laws.
5. Data accuracy & no professional advice
The underlying records are public data and may be incomplete, delayed, or contain errors. We present them on an "as is" basis and do not warrant their accuracy, completeness or fitness for a particular purpose. Nothing in the Service is legal, financial, planning or professional advice. You should verify details independently before acting.
6. Intellectual property
The Service, including its software, classification, scoring and presentation, is owned by us and protected by law. The underlying records remain the property of the State of New South Wales and are used under the applicable NSW Government data licence. 7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, loss of profits, or loss of business arising from your use of the Service. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded; where our liability cannot be excluded, it is limited (at our option) to resupplying the Service or paying the cost of resupply. Our total aggregate liability is otherwise limited to the fees you paid us in the three months before the claim.
8. Indemnity
You indemnify us against claims, losses and costs arising from your breach of these Terms or your marketing, outreach or other use of the Service in breach of any law.
9. Suspension & termination
We may suspend or terminate access if you breach these Terms or use the Service unlawfully. You may stop using the Service and close your account at any time. Provisions that by their nature should survive termination (including IP, disclaimers, liability and indemnity) survive.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
